  • West Hampstead Medical Centre will normally respond to a Subject Access Request within one calendar month of receipt.
  • This time period will not commence until the West Hampstead Medical Centre has confirmed and is satisfied as to the identity and authority of the applicant.
  • You will need to attend the surgery in person with a recognised form of photographic identity (original copy) to confirm your identity (i.e. Driving Licence / Passport). We will need to certify this, before we can begin to process your request.
  • West Hampstead Medical Centre may seek further information from the applicant as to the specific information requested.
  • Any request for further clarification will suspend the one calendar month period until the required information is received.

Access to Data

In line with the NHS ambition to become Paper-free by 2020 we routinely provide access to data electronically. We encourage patients to access this information through the Patient Access App Platform/App like the NHS app (website or mobile phone app) as it provides access in an easily navigated, accessible format. It also provides access to new data as / when it is added to the dataset. Alternatively the record can be provided electronically (consultations and investigations in PDF format, documents in TIFF format) through e-mail however if requesting a significant amount of data this may require multiple separate e-mails and the data set provided may well prove more difficult to navigate. Information sent via e-mail is encrypted while travelling on the secure NHS network but will travel unencrypted through the rest of the internet. We cannot be held responsible for the confidentiality / security of the data sent via e-mail once it leaves the NHS network.

The General Data Protection Regulation (GDPR) prohibits organisations charging for access to data unless the request is considered excessive, unfounded or repetitive. Printed copies of small data sets (e.g. single copies of specific clinic letters or results) will not fulfil these criteria. Printed copies of entire medical records may be considered excessive / unfounded given the ambition of the NHS to be paper-free. In any cases where the practice considers the request excessive, unfounded or repetitive further discussion will occur before the dataset is prepared and any fees payable. 

Identification

To safeguard and protect your data we are required to confirm your identity prior to processing a request. Therefore, please kindly ensure that you provide an original recognised form of photographic identity (ie: driving license, passport, or European Identity card)

  • Once your request has been received by the practice, a member of the team will contact you to request and arrange to view your ID in person.
  • Once your identity has been verified, we can process your request.
